The Verdict... Again:

I am enrapt by BBC2's trial and have a question to put to you all:

Should a jury give weight to whether or not a victim appears genuinely distressed?
Yes, how the evidence is given is part of the evidence
No - crocodile tears
Who? What? Huh?

I don't believe that it should do at all. Of course the courtroom does have elements of drama to it; how the barristers (or solicitors) present the evidence. However, it would be dangerous ground to put weight on the 'distressedness' of an alleged victim as you would essentially be turning the courtroom into a drama.

It's a definite no from me. The verdict has to be as dispassionate and clinical as possible.

How the evidence is given is part of the evidence, I think, but you have to be aware that in most circumstances it probably doesn't mean that much. People can fake tears, some people deeply affected may not let it show, some people are less emotional etc. etc.

The whole point of an adversary trial is to enable the magic powers that descend on 12 people when they take an oath. Of course the demeanour of witnesses is a part of the evidence! Jurors know how tall, how old, and what colour genuine rape victims are. They know how genuine rape victims, and genuine rapists, come into contact, behave, and speak during and after the crime. It seems almost superfluous to point out that jurors already know how a genuine rape victim will behave in court, but of course they do. They simply compare their knowledge of what to expectto the behaviour they see, and thus the truth is revealed.

Crocodile Tears, buyers remorse, vendetta, innocent men convicted, I could go on but you get the picture, hopefully in technicolour.

There is nothing new here.

For good or bad, juries already can (and do) give whatever weight they want, for whatever reason they want, to any evidence adduced. A witnesses' demeanour is already one of the things that jurors will note and give appropriate weight.

And of course, no-one is supposed to know what exact deliberations took place in the jury room, in UK jurisdiction.

Unfortunately I think our system requires physical evidence. In a "I say he did, he says he didn't" situation I'm not surprised 9 out 10 men aren't convicted.

Its the old adage of better 10 guilty men go free than 1 innocent man is jailed. I doubt though that the people to whom that applies have quite the same point of view.


Something that occured to me is thatthere was a great deal or persuasion and argument in the jury room. I wonder what would happen if all 12 were kept isolated and had to come to a decision without talking it over with anyone. Would you just find every jury would become a hung jury?
